Please read these Terms and Conditions (“Terms”) carefully. By accessing or using our website, placing an order for goods, or engaging our custom services, you agree to be bound by these Terms and Conditions, all policies incorporated by reference (including our Privacy, Shipping, and Returns Policies), and all applicable laws of the Republic of South Africa.

  • 1. General Legal Compliance

    1.1 South African Law: This website and these Terms are governed by the laws of South Africa.

    1.2 The Consumer Protection Act (CPA): Nothing in these Terms is intended to limit any mandatory rights you may have under the CPA, where applicable.

  • 2. Products & Services

    2.1 Handcrafted Collections:
    We design and fabricate original, artisanal items directly within our local workshop.

    • Solid Timber Goods: Natural variations in wood grain, color tones, character knots, and structural burls are completely unique to the raw organic materials used. These natural markers are standard industry features and do not constitute manufacturing defects.
    • Plush & Crochet Goods: Handcrafted textile items feature slight variations in stitching density, sizing patterns, and yarn dye-lot colorations. These character traits are inherent to the custom artisan process and are not deemed faults.
    • Digital Renderings & Imagery Disclaimer: Product imagery displayed across our digital storefront is for reference purposes only. Final product colorations, fabric depths, and timber hues may vary slightly from online photography due to workshop studio lighting variations, natural organic pigments, and individual consumer digital screen brightness or calibration settings.

    2.2 Custom Commissions and Personalization:

    • All bespoke furniture and custom fabrication services are strictly governed by an independent, mutually signed Scope of Work and final project quotation.
    • For any custom engravings, layout modifications, or personalizations (including names, specific text, or submitted digital graphics), the client retains sole responsibility for verifying the absolute accuracy of all assets provided. Saw & Stitch holds no liability for production errors, typos, or aesthetic dissatisfaction resulting from incorrect information or low-resolution files supplied by the client.
  • 3. Orders, Pricing, and Payment

    3.1 Pricing: All prices displayed on our storefront are in South African Rands (ZAR) and include VAT where applicable. We reserve the right to alter pricing configurations at any point without prior notice.

    3.2 Acceptance of Order: Your electronic checkout receipt acts purely as an acknowledgment of your request and does not signify our final operational acceptance. We reserve the absolute right to accept, limit, or decline your order at any time for reasons including material scarcity, production capacity limitations, or clear checkout pricing bugs.

    3.3 Payment Gateways: All digital monetary transactions are safely routed through secure, encrypted third-party payment gateways. Saw & Stitch never retains or stores your full credit card credentials on our servers.

    3.4 Made-to-Order & Manufacturing Disclaimer: To maintain our high standard of finish, many items featured on our website are not kept in immediate physical inventory and are manufactured on a made-to-order basis. If an item requires fabrication post-purchase, our team will communicate an estimated production window. While our workshop makes every logistical effort to honor these timelines, manufacturing schedules remain fluid non-binding approximations due to the slow-craft artisan process. We provide no absolute guarantees against production timeline overruns.

  • 4. Shipping, Delivery, and Risk

    4.1 Shipping Policy: All dynamic fulfillment metrics, white-glove transport arrangements, and associated logistical costs are governed by our standalone Shipping and Delivery Policy.

    4.2 Non-Binding Lead Times: Stated workshop lead times are strategic projections based on current project schedules. Time for delivery shall not be of the essence, and we hold zero liability for direct or indirect losses arising from transit or assembly delays.

    4.3 Carrier Limitations: Once a package or heavy freight consignment successfully handles off to our designated shipping courier or private white-glove carrier, Saw & Stitch is not legally responsible for transit delays, misdeliveries, or accidental handling damage caused by the carrier.

    4.4 Risk and Ownership:

    • Legal ownership of the physical goods transfers entirely to you only upon receipt of full invoice payment.
    • Risk of physical loss or damage transfers directly to you the moment the package is collected by our courier partners or personally picked up from our Sandton premises.
  • 5. Returns & Refunds

    5.1 Returns Framework: All item exchanges, returns, or refund claims are strictly governed by our standalone Returns and Refunds Policy, which aligns fully with your consumer protections under South African law.

    5.2 Solid Wood Collections Warranty: We warrant our solid timber collections against structural manufacturing defects and poor joinery workmanship for a period of 6 months from the date of final delivery. This warranty becomes instantly null and void if the item is altered, disassembled, modified, repaired by unauthorized third parties, or subjected to clear physical misuse, neglect, or improper indoor environmental conditions (such as exposure to direct sunlight or placing the item directly next to climate units/fireplaces).

    5.2.1 Natural Wood Disclaimer: Timber is a living, organic material that naturally expands and contracts with changes in seasonal indoor humidity. Minor movement, minor seasonal checking (hairline splits), or slight color variances are standard characteristics of premium wood and are explicitly excluded from warranty claims.

    5.3 Handcrafted Plush & Crochet Limited Warranty: Due to the soft, delicate nature of textile designs, our plush and crochet items carry a limited 14-day manufacturing warranty from the date of delivery. This warranty covers strictly out-of-the-box structural production defects, such as loose initial seams or unraveling yarn lines.

    5.3.1 Rough Play Exclusion: This limited textile warranty strictly excludes, and Saw & Stitch holds zero liability for, any damage resulting from normal wear-and-tear, pulling, biting, chewing, fabric tearing, staining, washing machine damage, or rigorous "rough play." Textile goods subjected to standard play or pet interaction naturally degrade over time, which does not constitute a product defect.

    5.4 Custom Commission Exclusion: Because bespoke builds are engineered entirely to unique client-specific dimensions, custom furniture commissions are completely non-refundable once the deposit is cleared and manufacturing has commenced. We guarantee structural conformance to your signed technical drawings and fully warrant our primary joinery workmanship.

  • 6. Limitation of Liability and Indemnity

    6.1 General Limitation: To the maximum extent permitted by applicable South African law, Saw & Stitch shall not be held liable for any direct, indirect, incidental, punitive, or consequential losses, damages, or personal injuries arising from the everyday use, storage, placement, or misuse of any of our custom fabricated products.

    6.2 Structural Modifications and Interference:

    The buyer explicitly agrees not to alter, structurally disassemble, or mechanically interfere with the structural components or internal fastening systems of any product built by Saw & Stitch.

    We disclaim any legal liability for structural failure, property damage, or physical injury resulting from secondary modifications or unauthorized repairs to our products. By finalizing your purchase, you agree to indemnify Saw & Stitch against any third-party claims arising from such interferences.

  • 7. Intellectual Property

    All creative and digital assets displayed across this storefront—including our logos, technical furniture sketches, original design configurations, photographic media, and the "Saw & Stitch" trade name—are the exclusive property of Nine Four Three Holdings (Pty) Ltd. You are strictly prohibited from copying, reproducing, or exploiting any of our proprietary intellectual property without our express, written workshop permission.
